The Board recently discussed a possible amendment regarding rentals in Prescot. We would like to include a clause in our "Covenants, Conditions, and Restrictions" (CCR's) that state, "once a deed is transfered (from one property owner to another) said property cannot be used as rental for the first 12 months' '. If a current deed holder/homeowner wishes to turn their property into a rental they would not be impacted by this amendment as there would not be a transfer in the deed, only the existing rental cap, which is 12%, would apply.
The purpose of this rental restriction is to discourage any one person or corporation from purchasing several properties within the same community to prevent any one person or corporation from holding a majority of votes in relation to annual Board of Director elections, annual budget ratifications, future potential amendments to governing documents, etc.
In order for this rental restriction to be approved, 67% or 145 homeowners in the community would need to vote in the affirmative. This means if someone doesn't vote, that is considered a vote against the amendment and would not count towards the 67% affirmative votes required.
In efforts to be fiscally responsible, the Board of Directors is sending this survey out to gauge community involvement before using HOA funds for attorney fees to draft the amendment and ballot as well as the cost of postage for the mass mailing.
If you are in favor of the proposed rental restriction amendment, please complete this survey to reflect your opinion with the understanding that in order for the amendment to pass we would need your signature on an official amendment ballot that would be distributed at a later date.
